SR Leader Files Amicus Brief with Supreme Court in Support of Universal Masking

We are so proud of one of our leadership team members, attorney and special education advocate Wendy Pizer. On Monday, (January 24, 2022), she filed an amicus (“friend of the court”) brief in support of the parents who sued Governor Youngkin in Castillo v. Youngkin. This case challenges Governor Youngkin’s Executive Order that requires schools to allow any student to opt out of universal masking requirements for any reason or no reason at all. Pizer filed on behalf of parents of a child with leukemia, who is immunocompromised and would be harmed if universal masking is not maintained in his school, without opt-outs.

The brief is a good read. She argues that the Executive Order violates state law, federal law and the Virginia Constitution — and is contrary to public health guidance, in addition to preventing immunocompromised children from being able to attend school safely.

Wendy Pizer is ready to stand up for the rights of children with serious medical conditions, who need universal masking in schools, and so are we as a coalition. The Governor of Virginia did not listen to us. We hope the Supreme Court of Virginia will hear us.
